| To All EFS Users: The purpose of this notice is to clarify how CMEs Exchange Fee System (EFS) will charge reduced rates to NYMEX members effective June 17, 2002. The CME will look at the Entry User ID submitted to GLOBEX via the appropriate FIX Tag (FIX 2.3/2.3 Express Tag 116 and iLink FIX 4.2 Tag 50). This ID will then be checked against an information database that is sent to CME by NYMEX to determine whether the ID belongs to a NYMEX member. If the ID belongs to a registered NYMEX member, then the reduced NYMEX member rates will be applied. If the ID does NOT belong to a registered NYMEX member, then customer rates will be applied. There is no set-up required by EFS users to identify accounts owned by NYMEX members. The trades will be identified as being executed by NYMEX members via the above described process. ALSO: The new E-miNY products that are launching on June 17, 2002 will be cleared only at NYMEX. CME members must clear trades in these products through a NYMEX clearing member. Therefore, all clearing and transaction fees associated with these products will be charged by NYMEX. There will be no fees for these products charged via EFS, and therefore, there will be no fees for these products on your bills from CME. If you have any further questions regarding this CME/NYMEX initiative, please contact me at 312.648.5470 or Jill Thompson at 312.454.8334. Thank you.
